This Privacy Policy explains how Upp ("we," "us," or "our") collects, uses, processes, and protects information when you access or use our mobile application, website, and related services (collectively, the "Service"). It also describes your rights and choices regarding your information. By using the Service, you acknowledge and agree to the practices described in this Privacy Policy.

Definitions and Scope

An Account refers to a user profile created to access features of the Service. The Application refers to software operated by Upp. Personal Data means information that can reasonably be linked to an identifiable individual. Usage Data refers to technical or behavioral information collected automatically through use of the Service. A Device means any phone, tablet, or computer used to access the Service. You refers to the individual or entity using the Service.

Information We Collect

We collect limited information necessary to operate the Service effectively. This may include information you voluntarily provide when creating an account, contacting support, or interacting with app features. We also automatically collect Usage Data such as device type, operating system, app interactions, timestamps, IP address, and diagnostic data used to ensure functionality, security, and performance. We do not collect information unrelated to the operation of the Service.

Exercise and Motion Data

Upp may process motion, step, or exercise-related data solely to enable app functionality and improve user experience. All such data is processed locally on your device. Upp does not store, transmit, or retain exercise or motion data on its servers. Users may delete this data at any time through device or app settings.

Visual AI and Camera Processing

Upp uses visual AI solely for real-time, on-device verification of user actions required to access or dismiss certain app features. The camera is never used to record, capture, save, upload, transmit, or store images or video. No photos, videos, or frames are retained. All visual processing occurs entirely on the user's device and is never stored. Upp does not perform facial recognition, does not create biometric identifiers, and does not maintain any visual records of users. Camera access exists only while required for functionality and may be revoked at any time through device permissions.

How Information Is Used

Information collected through the Service is used to operate and maintain the Service, provide core features, manage user accounts, communicate regarding updates or support, improve performance and reliability, analyze usage trends, enforce policies and legal obligations, and evaluate corporate transactions such as mergers or acquisitions. Upp does not use camera data, visual inputs, or exercise data for advertising, profiling, or tracking.

Data Retention

Personal Data is retained only for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, and enforce agreements. Usage Data may be retained for a limited time to support security, analytics, and system integrity.

Data Transfers

Information may be processed on systems located outside your state or country. By using the Service, you consent to such processing. Upp applies reasonable safeguards to protect information regardless of processing location.

Your Rights

Disclosure of Information

Information may be disclosed in connection with a corporate transaction, such as a merger or asset sale, subject to notice where required. Children

The Service is not intended for children under the age of 13. Upp does not knowingly collect Personal Data from children. If such data is identified, it will be deleted promptly.

The Service may reference or link to third-party services not operated by Upp. We are not responsible for the privacy practices or content of third parties.

We may update this Privacy Policy from time to time. Updates become effective when posted, and the "Last updated" date will reflect the most recent revision. Continued use of the Service after updates constitutes acceptance of the revised policy.
